These Terms of Service ("Terms") are a legal agreement between you and ApakaTech ("we", "us", or "our") governing your use of the CtrlBright desktop application and our website (collectively, the "Service"). By downloading, installing, or using CtrlBright you agree to be bound by these Terms. If you do not agree, do not download or use the Service.
By accessing or using CtrlBright you confirm that you are at least 13 years of age (or the minimum digital age of consent in your jurisdiction), that you have the legal capacity to enter into this agreement, and that you have read and understood these Terms and our Privacy Policy, which is incorporated herein by reference.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use CtrlBright solely for your personal, non-commercial purposes on Windows devices you own or control. All rights not expressly granted to you are reserved by ApakaTech.

CtrlBright currently does not require you to create an account to use the core application. If you contact us for support you may provide an email address; you are responsible for keeping that information accurate. If account-based features are introduced in the future, additional terms will apply and you will be notified before they take effect.
CtrlBright, its source code, design, graphics, text, and all related materials are the exclusive property of ApakaTech and are protected by copyright, trademark, trade secret, and other intellectual property laws. The CtrlBright name and logo are trademarks of ApakaTech and may not be used without prior written permission.
You retain ownership of any content on your own device; we make no claim to your files, projects, or personal data.
We may release updates, patches, or new versions of CtrlBright at any time. Some updates may be installed automatically; others will require manual action. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without liability to you.
The Service may contain links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party services you visit.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that CtrlBright will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, ApakaTech and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of or inability to use the Service, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) ₹500 INR / $10 USD.
You agree to defend, indemnify, and hold harmless ApakaTech and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service or violation of these Terms.
These Terms remain in effect until terminated. You may stop using CtrlBright and uninstall it at any time. We may suspend or terminate your access to any online components of the Service immediately, without prior notice, if you breach these Terms or if we reasonably suspect misuse. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
These Terms are governed by the laws of the State of Maharashtra, India, without regard to its conflict-of-law principles. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.
We reserve the right to update these Terms at any time. When we do, we will revise the "Last updated" date at the top of this page. We will provide reasonable notice of material changes — for example, by posting a notice on our website or (where applicable) sending an email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
